OFFICIAL RULES OF #VC_SoccerFilmFest CAMPAIGN

 

 

1.ENTRY:  NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE, AND THE CHANCES OF WINNING ARE NOT ENHANCED BY MAKING A PURCHASE. Contestants will enter by submitting a 30-second or less video within the VOTOCAST mobile application during the Campaign Period.

·         Entries must be videos related to “Soccer: The Game of Life” that celebrate and/or explore how the Beautiful Game gives life to players, fans, cities, and nations.

·         Entries must be the original work of entrant previously unpublished work and not include any material owned or controlled by third parties (including without limitation, third party copyrighted material)

·         Contestants must provide upon request all appropriate clearances, permissions and releases for the entry (in the event a contestant cannot provide all required releases, Sponsor reserves the right, in its sole discretion, to disqualify the entry, or seek to secure the releases and clearances for Sponsor benefit, or allow the entry to remain in the Contest)

·         Entries must not contain material that is inappropriate, indecent, contain profanity, nudity, sexual content; hateful content of any kind; content that promotes violence or harm to another living creature; or any other offensive content (as determined by Sponsor in their sole discretion).

·         Entries must not contain material that promotes alcohol, illegal drugs, tobacco, firearms / weapons (or the use of any of the foregoing) or promotes any activities that may appear unsafe or dangerous.

·         Entries must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

·         Entries must not violate or encourage the violation of any law, rule or regulation.

 

If any entry violates any of the above requirements, it will be disqualified.

 

2. ELIGIBILITY: This Campaign is open only to participants who are thirteen (13) years old or older as of time of entry. Contestants under the age of majority must receive prior permission from legal parent or guardian to enter and their legal parent or guardian must also agree to these Official Rules. If a contestant under the age of majority wins a prize, the prize will be awarded to the parent or legal guardian upon receipt of all required documents.  Void where prohibited by law.  Videos must be original content, filmed by the contestant and may not infringe on any third party rights.  Officers, directors, and employees of Sponsor and its parent, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies, and each of their immediate family members and/or people living in the same household are NOT eligible to enter the Campaign or win a prize.

 

3. CAMPAIGN PERIOD: The Contest and Sweepstakes (“Campaign”) will begin at 12 AM PST on August 8, 2016 and end at 11:59 PM PST on August 29, 2016 (“Campaign Period”).

 

4. CAMPAIGN WINNERS: 

Contest: Up to four (4) winners may receive a prize. Voting will be available during the Campaign Period.  The video with the most votes will receive 10 points .  The video with the second most votes will receive 9 points and so on, through the Top 10.  The Kicking + Screening Contest Jury will also judge the videos based on creativity (25%), quality (25%), originality (25%) and applicability (25%) related to the theme. The Kicking + Screening Contest Jury will also apply a point system to the Top 10 videos by public vote, with the top rated video receiving 10 points, the second rated video receiving 9 points, and so on.

 

The top four (4) videos with the most amount of combined points will be the winners.  In case of draw for the number of points on two or several videos, the Kicking + Screening Contest Jury ranking shall prevail.

 

Sweepstakes: One (1) winner may receive a prize.  During the Campaign Period, any Producer who uploads a qualifying video will be entered into the Sweepstakes.  You must have a valid VOTOCAST account to enter via this method, which requires an email address. 

 

During this Campaign Period, you may also enter the Sweepstakes by mail as follows.  On a plain 3”x5” index card, legibly handprint or type your first name, last name, date of birth, complete address, city, state, zip code, phone number (including area code) and email address (if any).  To receive on sweepstakes entry, mail that 3”x5” index card to:

To be considered eligible in this Sweepstakes, your entry must be postmarked no later than August 24, 2016 and received by Kicking + Screening no later than August 29, 2016.

 

Only one sweepstakes entry per person regardless of method of entry.

 

5. CAMPAIGN PRIZES: 

Contest: The Top 4 winning videos will be screened during The Kicking + Screening Soccer Film Festival, to be held September 13-16, 2016 in New York, NY. The Top 10 videos by public vote will be announced and promoted on the Kicking + Screening public website and social media channels.

 

Sweepstakes: One (1) winner will receive a prize.  The winning entry for the Sweepstakes prize will be chosen in a random drawing from all eligible Sweepstakes entries during the Campaign Period.  Odds of winning depend on he number of eligible entries received for the drawing.  Subject to verification of eligibility and compliance of these Official Rules, the winning entry chosen as determined by the Sponsor, will be deemed the potential Sweepstakes prize winner.

 

Sponsor reserves the right to substitute Campaign Prizes for an item of equal or greater value.  Campaign Prizes are awarded “as is” and are non-transferable.  All other expenses not specified herein are the responsibility of the winner.  All taxes on Campaign Prizes are the sole responsibility of the winner.  Limit one prize per person.

 

6. WINNER NOTIFICATION:  Winners will be notified via e-mail on September 6, 2016. The winner will be required to respond to the e-mail notification to acknowledge receipt of Sponsor’s notification and awarding of the prize.  The actual prize will not be physically rewarded to winner until such time deemed possible by Sponsor.  The winner will be required to prove eligibility to receive and claim any prize. Any winner who is under the age of majority will be required to have written parental consent to the contestant’s entrance, awarding acceptance and receipt of the prize, and to all of the conditions and terms set forth in these Official Rules other eligibility requirements, releases and waivers. The prize will be awarded to the winner after the winner responds to the initial email notification and satisfies all eligibility requirements. All decisions of Sponsor about the winner are final, binding and non-appealable. Sponsor is not responsible for any incorrect or illegible address information or the non-delivery of any prize resulting therefrom, or for any unsuccessful efforts to notify a winner.

 

It is the sole responsibility of the contestant to notify VOTOCAST via email if the contestant changes his/her contact information. (support@VOTOCAST.com).

 

7. GENERAL CONDITIONS:

a. Campaign participants hereby grant VOTOCAST and Sponsor a non-exclusive, perpetual, fully paid, royalty free, worldwide license to broadcast, publish, store, reproduce, sublicense (including for profit), distribute, syndicate, and otherwise use and exhibit the Submission (along with their names, voices, performance and/or likenesses) in all media now known and later come into being for purposes of trade or advertising without further compensation. Contestants represent and warrant that they have full legal right, power and authority to grant VOTOCAST and Sponsor the foregoing license and if applicable, have secured all necessary rights from any participants in, and contributors to, their Submission in order to grant such a license.

 b. VOTOCAST and Sponsor under no obligation to use any Submission or return the Submissions to contestants.

c.  By making a Submission in the Campaign, contestant(s), and each of them, represent and warrant to VOTOCAST and Sponsor that the Submission is not libelous, slanderous, obscene and does not plagiarize; and that VOTOCAST’s use of the Submission or any information contained therein as contemplated herein will not infringe upon any copyright, trademark, right of privacy or any other rights whatsoever of any third party. Each entrant shall hold VOTOCAST and Sponsor harmless and shall indemnify VOTOCAST and Sponsor for all costs and expenses (including reasonable attorney fees’) in the event of a breach of any of the foregoing warranties or representations.

d. To participate in the Campaign, Participant must be registered with VOTOCAST, and subject to all of VOTOCAST’s Terms of Service.

 

8. USE OF CAMPAIGN INFORMATION: VOTOCAST and Sponsor reserve the right to use any and all information related to the Campaign, including Submissions provided by the contestants, for editorial, marketing and any other purpose, unless prohibited by law. 

 

9. PRIVACY: VOTOCAST may use any of the contestant’s personal information submitted in connection with the Campaign per the terms of the Privacy Policy located at www.VOTOCAST.com or within the VOTOCAST mobile application including, without limitation to publicize the Campaign and contestant’s winnings.  VOTOCAST will provide Campaign winner contact information to Sponsor for Winner Notification.

 

10. NO INVOLVEMENT BY APPLE: Apple is not involved in any way with this Campaign.  Campaign Prizes do not contain any Apple products.

 

11. CONDUCT: All Campaign participants agree to be bound by these Official Rules.  VOTOCAST and Sponsor in their sole discretion, reserve the right to disqualify any person it finds to be tampering with the entry process, the voting process, the operation of its web site, submitting videos that do not relate to the Campaign or is otherwise in violation of these rules.

 

12. LIMITATIONS OF LIABILITY: VOTOCAST and Sponsor are not responsible for late, lost or misdirected email or submissions or for any mobile, computer, online, telephone or technical malfunctions that may occur.  If for any reason, the Campaign is not capable of running as planned, including because of infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, VOTOCAST and/or Sponsor may cancel, terminate, modify or suspend the Campaign.  Contestants further agree to release VOTOCAST and Sponsor from any liability resulting from, or related to participation in the Campaign.

 

13. RELEASE: Acceptance of a prize constitutes winner’s permission for VOTOCAST and Sponsor to use winner’s name, photograph, likeness, voice, biographical information, statements, and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation.  Entrants agree that VOTOCAST and Sponsor (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Campaign or any Campaign-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.

 

14.  DISPUTES: By entering the Campaign, contestants agree that:

a. Any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering the Campaign, but in no event attorneys’ fees; and

b. Under no circumstances will any contestant be permitted to obtain any award for, and contestant hereby waives all rights to claim punitive, incidental, indirect, or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. Some jurisdictions do not allow for limitations on the ability to pursue class action remedies, or certain kinds of damages, and so these limitations may not apply to you.

 

If there is any discrepancy or inconsistency between any Official Rules and any disclosures or other statements contained in any other Campaign-related materials, including but not limited to print, mobile or online advertising, these Official Rules will prevail, govern and control.

 

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the contestant in connection with the Campaign, will be governed by California law, without giving effect to any choice of law rules that would cause the application of the laws of any jurisdiction other than California. All contestants expressly agree that any legal proceedings arising out of or relating in any way to this Campaign or these Official Rules must be brought only in the federal or state courts located in Los Angeles or Orange County, and contestants consent to the mandatory and exclusive jurisdiction in such courts with respect to any such legal proceedings.

 

If any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

 

15. REQUEST FOR WINNERS: For the names of the winners, available thirty (30) days after the Campaign Period, send a self-addressed, stamped envelop to:

16. CAMPAIGN SPONSOR:  The sponsor of the Campaign is the Kicking + Screening Soccer Film Festival. The Campaign is in no way sponsored, endorsed, or administered by or associated with any other social media or brand website or platform on which it may appear.
